Dust is considered a nuisance under the Environmental Protection Act (1995) if:
- it can be shown to be harmful to the health of the average person, or
- if it interferes with the use or enjoyment of your property
The most common cause of dust complaints is construction and development.
We don't take action on complaints about:
- dust from works on the highway or
- dust from road sweeping
Report airborne dust
In most cases, the best way to stop airborne dust nuisance is by speaking to the person responsible for causing it. They may not know that they are causing a disturbance.
If this doesn't work, you can report the issue to us by:

You'll need to tell us:
- about the problem
- where the problem is (your address an the address of the problem)
- your name
- your contact details
We don't accept anonymous reports. This is because we need to be able to contact you to discuss the issue.
Your identity will be protected under data protection regulations. You should keep in mind that if your report goes to court your identity may need to be revealed.
